CONTRACT BETWEEN THE CITY OF MASCOUTAH AND LEU CIVIC CENTER, INC.
This document represents an agreement between the City of Mascoutah (City), a municipality in the State of Illinois, and Leu Civic Center, Inc, (LCC, Inc,), a private non-profit 501c(3) organization. The contract supersedes all previous agreements between the City and LCC, Inc. This contract will remain in effect until such time as either party desires to terminate the contract. The contract will be reviewed for currency and applicability (and revise if necessary) during the first week of April every year
WHEREAS, the City has a responsibility to provide recreational activities and youth programs for its citizens: and
WHEREAS, the City is responsible for maintaining its public property; and.
WHEREAS. the Leu Civic Center is a non-profit organızatıon (funded 1n part by United Way), and dedicated to providing recreational activities and programs:
NOW, THEREFORE in consideration of the covenants and agreements hereinafter set forth, it is mutually agreed as follows:
The City of Mascoutah shall:
- Provide to LCC, Inc., the property at 2 13 North Market Street, Mascoutah Illinois, known as the Leu Civic Center, Inc
- Provide building insurance, activity, and all other insurance as provided for in the City of Mascoutah’s standard Illinois Municipal League Risk Management Association (IMLRMA) policy
- Provide personnel for building maintenance, janitorial service, and outside property care, Generally, this will not exceed an average of two (2) hours per day, except where special situations or requirements might otherwise dictate
- Provide utilities in the form of electricity, water, sewer, telephone and fiber data services
- Provide payroll services for the United Way-funded staff employed at LCC Inc
- Prepare thorough consultation with the Leu Civic Center Board of Directors an annual budget for the expenses related to services previously listed in the preceding paragraphs, and for any other miscellaneous supply expenses that may be required. This will be prepared as an attachment to this contract and will be updated each year with the budget for the New Year
- Not use the building for purposes other than LCC, Inc. activities unless separately agreed upon between the two parties, or unless in emergency situations; e.g. severe storm shelter, natural or man-made disaster
The Leu Civic Center. Inc. shall:
- Provide a safe gathering place for the community to come together, regardless of ethnic background or financial condition, to socialize, participate, enjoy and share in the family and community structured program service.
- Develop programs and activities to provide the general public with recreational and educational activities that meet the needs of the community and solely use the property provided for this purpose
- Provide personnel to staff the center and supervise activities
- Provide necessary funding for employees’ salaries and benefits
- Periodically, evaluate membership and fees, and conduct membership drives and adjust fees as may be required
- Make every effort to hold utilities cost to a minimum
- Make every effort to maintain the building in good condition
- At the end of each fiscal year provide the City of Mascoutah with a copy of financial statements for year end
- Provide the City a copy of the LCC monthly schedule of events prior to the end of the previous month
Both Parties shall;
- Coordinate and discuss any proposal to alter the building (inside or outside prior to any commitment of such work
- Meet and discuss any issue involving the building and its operation that is not covered in this contract
- Coordinate and discuss responsibility for costs to maintain and/or make repairs to the building. This agreement shall be binding upon the parties, their executors, administration, her and The parties hereto have affixed their signatures this )” day January 2, 2020.
